Final USCIS “Public Charge” Rule Does Not Include Federal Student Aid Programs(NASFAA news for August 13, 2019)
The United States Citizenship and Immigration Services (USCIS) on Monday published its final "public charge rule," which would require consideration of whether a noncitizen seeking admission into the United States, or an adjustment to their status, would or has relied heavily on public programs as a determinant of whether they could strain government resources. The final rule, which will be available in the Federal Register Wednesday, does not include financial aid programs. While there was public concern that without specifying a list of programs the rule does not apply to, it may steer students away from seeking financial aid, the agency said it could not include that list in the final rule because the programs are “too numerous” and “may change over time.” Higher education experts have also expressed concern that the rule affects supports for students such as the Supplemental Nutrition Assistance Program (SNAP).
